TERMS AND CONDITIONS

By booking travel services with Sips and Sights Travel LLC, a Florida Limited Liability Company and independent affiliate of Legato, you agree to be bound by these terms and conditions (“Terms”), which outline the responsibilities and obligations of both the Client
(“you,” “your”) and Sips and Sights Travel LLC (“we,” “us,” “our”). Please read them carefully before booking.

1. Scope of Services
Sips and Sights Travel LLC (“Sips and Sights Travel”) acts solely as a booking agent for travel suppliers including but not limited to airlines, hotels, tour operators, cruise lines, ground transportation providers, and activity companies (collectively, “Suppliers”). We arrange travel services on your behalf, but all bookings are subject to the Supplier’s terms, conditions, and policies. Sips and Sights Travel does not own, operate, or control any Suppliers.

2. Client Responsibilities
You are responsible for reviewing all documentation provided, including but not limited to invoices, itineraries, airline tickets, hotel confirmations, and Supplier terms and conditions. It is your responsibility to ensure accuracy of all information including names (matching passport/government ID), travel dates, and destinations. You must comply with all applicable laws, rules, regulations, and travel requirements.

3. Service Fees and Payments
Planning and booking fees charged by Sips and Sights Travel are non-refundable. In addition, certain reservations may require deposits or full payments subject to Supplier rules. By submitting payment, you authorize us to use your payment information to process transactions with Suppliers. Failure to make timely payments may result in reservation cancellation, with applicable penalties.

4. Cancellation, Refunds, and Changes
All cancellations or modifications must be requested in writing. Sips and Sights Travel charges a cancellation fee of 10% of the total booking cost if cancelled more than 31 days prior to travel, or 15% if cancelled 30 days or fewer prior to travel. This fee is in addition to any Supplier imposed penalties. Refunds, if permitted, are subject to Supplier policies and may take up to 90 days to process. Sips and Sights Travel has no control over Supplier decisions on refunds or credits.

5. Supplier Responsibility and Liability
Sips and Sights Travel is not responsible for the acts, errors, omissions, representations, warranties, breaches, or negligence of Suppliers. We are not liable for personal injury, property damage, delays, inconvenience, overbooking, cancellations, bankruptcies, or force majeure events beyond our control. All claims must be directed to the Supplier.

6. Travel Protection/Insurance
Travel protection and insurance are strongly recommended. Insurance may cover certain risks including trip cancellation, interruption, medical emergencies, lost baggage, and supplier default. By declining travel insurance, you acknowledge that Sips and Sights Travel is not responsible for any losses, damages, or expenses that insurance may have otherwise covered.

7. Travel Documents and Requirements
You are solely responsible for obtaining and maintaining all necessary travel documents, including valid passports, visas, vaccination certificates, and any other entry requirements. Failure to comply with these requirements may result in denied boarding or entry at your own expense.

8. Health and Safety Risks
Travel involves risks including illness, injury, accidents, and exposure to contagious diseases. By booking, you assume full responsibility for these risks. It is your responsibility to consult medical professionals for guidance on vaccinations, health requirements, and precautions.

9. Accessibility/ADA Compliance
Sips and Sights Travel cannot guarantee that Suppliers comply with the Americans with Disabilities Act (ADA) or similar laws. You are responsible for confirming accessibility directly with Suppliers.

10. Behavior and Conduct
You must follow Supplier rules and regulations during travel. Sips and Sights Travel and Suppliers reserve the right to refuse service or remove travelers for inappropriate or unsafe behavior without refund.

11. Limitation of Liability
Sips and Sights Travel’s liability is strictly limited to the amounts paid for our direct services (excluding Supplier charges). To the fullest extent permitted by law, Sips and Sights Travel disclaims all liability for indirect, consequential, or incidental damages.

12. Indemnification
You agree to indemnify, defend, and hold harmless Sips and Sights Travel, its employees, contractors, officers, and agents from any claims, damages, losses, or expenses (including attorney’s fees) arising from your acts, omissions, or violations of these Terms.

13. Force Majeure
Sips and Sights Travel is not responsible for failure to perform due to causes beyond its control, including but not limited to natural disasters, pandemics, government actions, labor disputes, war, terrorism, or Supplier insolvency.

14. Governing Law and Venue
These Terms are governed by and construed in accordance with the laws of the State of Florida. Any disputes shall be resolved exclusively in the state or federal courts located in Florida.

15. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in effect.

16. Entire Agreement
These Terms, together with Supplier terms and conditions, constitute the entire agreement between you and Sips and Sights Travel and supersede all prior understandings.
